Many working mothers face a major dilemma when it comes to pursuing a career and planning to give birth. Concerns about losing their jobs and difficulties in balancing work and caring for a baby. 

 

To address these concerns, the Indonesian government has introduced regulations regarding maternity leave. Law No. 4 of 2024 on Maternal and Child Welfare (KIA) introduces important updates regarding maternity leave rights for female employees. These regulations will take effect starting in 2025 and bring significant changes to the protection of female employees' rights.

 

Duration of Maternity Leave

 

Under the new KIA Law, every working mother is entitled to a minimum of three months of maternity leave. This leave must be provided by the company for mothers who give birth. The regulation also allows for an additional three months of leave, bringing the total leave period to six months. However, this applies only if the mother and/or child experience postpartum health issues, as evidenced by a doctor's certificate.

 

Women Employees' Rights During Leave

 

During maternity leave, female employees continue to receive their full salary and benefits. For the first three months, working mothers receive 100 percent of their salary. If the leave is extended to six months, the salary for the next three months is paid at 75 percent. 

 

Additionally, female employees cannot be terminated from their jobs during maternity leave and continue to receive protection in accordance with labor regulations.

 

Protection and Respect for Working Mothers

 

The government emphasizes that companies must respect the rights of working mothers to prevent discrimination, particularly in the recruitment process. This maternity leave is a form of recognition for women who bring new generations into the world in good health and provide optimal time for child care. 

 

The new regulations also include a 45 days or 1,5 months miscarriage leave and a few days of paternity leave for the husband during childbirth.
